Criminal & Traffic Law

Facing any criminal charge can be life changing. The criminal law is complex and there is a range of intrusive consequences that can occur if you are convicted of an offence: fines, supervision orders, restrictions to your movement, licence suspension, and gaol.

Our first aim is to prevent a conviction wherever possible.  

We are careful, experienced and respected advocates throughout the courts of NSW and in the ACT. We understand the stress and inconvenience of attending court, and our service is focused on achieving the best possible outcome in the circumstances, as quickly as possible. In certain circumstances, we negotiate with prosecuting authorities on your behalf to reduce or withdraw the charges.

We represent clients in all jurisdictions for criminal offences ranging from the less serious offences, such as drink and drug driving offences, traffic offences and driver licence appeals to the most serious criminal charges dealt with by the higher courts. Our advocacy services in crime are:

Family Law

The breakdown of a relationship is very often a stressful and emotional time. We have vast experience in all kinds of family law issues, including divorce, parenting and property disputes and mediations. We are able to assist you in navigating the complexities of the family law system. This area of the law requires trusted and personal advice, from professionals whom can bring an open mind to your circumstances in order to find the creative solutions to the problems you face. No dispute in this area is the same as the next, and often the solution is as unique as the problem itself.

We endeavor to negotiate settlement outcomes without the need to commence court proceedings provided that our clients’ interests, and in the case of parenting disputes, the best interests of the child/children, are at the forefront of such negotiations. We can assist in formalising agreed outcomes by way of Consent Orders, Binding Financial Agreements or Parenting Plans.


 

Wills, Enduring Power of Attorney and Probate

 

Preparing a will is an essential part of Estate Planning. At Vozella Lawyers we can assist with the drafting and preparation of your will. We can also assist in advising you in relation to any potential family provision claims which may arise depending on the terms of your will, selecting your Executor/s or Trustee/s and the duties and responsibilities of your Executor/s and or Trustee/s. If you die without a valid will the law decides who gets your assets. This is called ‘dying intestate’. It is important to seek legal advice when it comes to preparing your will as this will not only ensure that your wishes are properly provided for, but it will also assist in the ultimate administration of your estate.  

We can also assist in the preparation of Power of Attorney, Enduring Power of Attorney and Enduring Guardian documents. Depending on your circumstances, such documents are vital should there be a need presently or in future for a third party to act on your behalf in relation to financial, legal or health decisions. 

Being named as an Executor in a will comes with significant responsibility. One such responsibility is the requirement to obtain a grant of Probate or in some circumstances a grant of Letters of Administration. A grant of Probate or Letters of Administration may not always be required in order to administer an estate in accordance with a valid will. We are able to advise you on whether such steps are necessary in the administration of a particular estate and provide guidance as to the alternative mechanisms available. If a Grant of Probate or Letters of Administration is required, we are able to act on behalf of Executors and Administrators in applying to the Supreme Court for the appropriate grant and distributing the assets of the estate.
